Veteran’s Administration Benefits

Contrary to what many people believe, a veteran of our armed services does not have to be injured in combat or serve overseas to be eligible for veterans’ benefits. As a result, some veterans and veterans’ spouses are not getting the benefits they have earned through their service.

Obtaining Veterans’ Benefits

There are two branches of the Veterans Administration: the Veterans Health Administration, the primary purpose of which Is to provide health care for prior service members, and the Veterans Benefits Administration, the primary purpose of which is to administer monetary benefits programs for eligible veterans.

All veterans who served in the military and received a discharge other than dishonorable can take advantage of the veterans health care services, Also, the government pays VA benefits in cash to assist with the costs of assistance with Activities of Daily Living (ADL’s) for eligible veterans and their spouses.

  • A married couple in which the veteran needs assistance may be entitled to up to $1,949 per month in benefits.
  • A single veteran may be entitled to up to $1,644 per month.
  • A veteran’s spouse may be entitled to about $1,056 per month.

These benefits are paid in cash and can be used to pay for nursing home care, assisted living facility care, home health care or the, services related to ADL’s.

Although $80,000 in “countable” assets is typically all that the applicant will be allowed to own, the VA may also consider the claimant’s life expectancy and demand lower total assets. In any case where there are assets over $50,000 it may be best to consult with an elder taw attorney. Many veterans have applied for benefits and been rejected. Or. they have been told by a VA service organization that because their assets exceed the threshold, they cannot get benefits. This is not necessarily true and does not have to be a barrier to obtaining veterans’ benefits.
